Family sues school over band membership

Student claims Lower Burrell won't let him participate because he is going to Catholic school A standout saxophone player from Lower Burrell sued his home school district yesterday in federal court, claiming that he is being denied permission to participate in the high school marching band because he will attend a Catholic school in the fall. Alexander Trefelner, who filed the suit along with his parents against the Burrell School District, said he is being denied his right to free exercise of religion. According to the complaint, Alexander, who also plays in the Westmoreland County Band, the Alle-Kiski honors band, and the Wind and Jazz Ensemble at Seton Hill College, was chosen last year to participate in the high school marching band while still only in eighth grade in the district. Instead of moving on to Burrell High School, he plans to attend St. Joseph Catholic High School in Natrona Heights in the fall. It does not have a marching or jazz band. Alexander's mother, Shirley Trefelner, wrote to Burrell School District in April, asking that her son be allowed to continue in the extracurricular band programs there next year. However, high school Principal John C. Boylan denied her request, the lawsuit said, saying that students must be enrolled in the district to participate in extracurricular activities.     and John C. Boylan is right!!!!!! This has to be the most stupidest thing i ever read, this lawsuit is crazier then when Peter Griffin sued his doctor for giving him a prostate exam lmao(saw it on TV last night lol) If the young boy wants to be in that school's marching band, he has to be an enrolled student there, plain and simple!!!!! Plus what is even more of a discrace to me, HE IS A DAMN SAXOPHONE PLAYER!!!!! said to be a good player if he was selected out of a group of his peers to march with the high school marching band. This young man needs to decide quickly before the courts laugh their asses off at this because wel ldamn, of course they are not going to let a student who is not even enrolled in the school partisipate in their band just because the school he is attending does not have any kind of band. THATS ON HIM!!!!

  • Plain and simple; you have to be enrolled in the school in order to play in their band. I could of sworn FAMU got in trouble for that a few years ago. I think that's with any school. You have to be enrolled in the school in order to play or participate in their extracurricular activities that are sponsored by the school.

  • I can KINDA understand colleges in the same town IF they have some type of cross-enrollment argreement.

    Not so much with high schools, unless you're at a district charter school, and you go to the closest school with extracurriculars IN THAT DISTRICT!!!

    This cat is at a private school, and not part of the school system of the band he wants to be in.

    Some people in Houston had that bad a few years ago.

    You go to a school with a pretty good band, but because you don't like taking orders, you practice and perform with another school's band after school, and they let you get away with it...not cool...
